Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the website highscoretcg.com and the purchase of products from TopTierTCG (“TopTierTCG”, “we”, “us”, or “our”), a sole proprietorship operated in the Republic of South Africa.

By placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refund Policy

If you do not agree to these Terms, you should not use our website or place an order.

For purposes of these Terms, a “Business Day” means any day other than a Saturday, Sunday, or official public holiday in South Africa.


1. Contract Formation

An order placed on our website constitutes an offer to purchase.

A binding agreement is formed only when:

• Payment has been successfully authorised and received; and
• We confirm that the order has been accepted for processing and dispatch.

We reserve the right to refuse or cancel any order prior to dispatch, including where:

• There are payment verification concerns;
• We suspect fraud, automated purchasing, or resale arbitrage;
• Products are unavailable due to supplier shortages;
• A pricing or system error has occurred.

If we cancel an order after payment has been received, a refund will be issued in accordance with these Terms.


2. Pricing and Errors

All prices are listed in South African Rand (ZAR).

VAT is not charged as TopTierTCG is not a VAT-registered vendor.

While we take reasonable care to ensure pricing accuracy, errors may occur. Where a product is listed at an incorrect price due to typographical, system, or supplier error, we reserve the right to cancel the order prior to dispatch and issue a full refund.

Obvious pricing errors do not constitute binding offers.


3. Payment

Payment must be made using the approved payment methods available at checkout.

Orders will not be processed or dispatched until payment has been successfully authorised and cleared.

We may conduct additional verification for high-value or high-risk transactions.

Failure to respond to verification requests may result in order cancellation.


4. Product Information and Availability

Product descriptions, images, and release dates are provided for general information and may vary slightly from the final product supplied.

We do not guarantee ongoing product availability. Products may be withdrawn or discontinued without notice.


5. Sealed Trading Card Game Products

We sell sealed trading card game products and accessories manufactured and packaged by third-party publishers.

Normal retail and manufacturing variations may include:

• Minor shrink-wrap tears or looseness
• Slight dents or corner wear to outer packaging
• Factory print imperfections
• Minor scuffing from distribution handling

Such variations do not constitute defects.

We do not guarantee:

• Pull rates
• Specific card inclusion
• Investment return
• Market value stability
• Future resale value
• Grading outcomes
• Centering, surface quality, or print alignment beyond general manufacturing standards

Purchases are made at your own discretion and risk regarding market value and grading outcomes.


6. Single Cards (Future Offering)

Where single cards are offered for sale:

Condition grading (e.g., Near Mint, Lightly Played) is based on our reasonable subjective assessment.

Minor surface scratches, centering variance, or edge wear may exist even in cards described as Near Mint.

No guarantee is made regarding third-party grading outcomes.

Returns for single cards will be handled in accordance with Section 9 of these Terms and the Consumer Protection Act.


7. Pre-Orders

Pre-orders allow you to reserve products prior to official release.

Unless otherwise stated, payment is collected in full at checkout.

You acknowledge that:

• Release dates are estimates only;
• Supplier allocations may change without notice;
• We are not liable for supplier shortages or release delays.

If we are unable to fulfil your pre-order due to allocation shortages, you will receive a refund for the unfulfilled portion.

We reserve the right to cancel pre-orders where supplier pricing materially changes prior to release. In such cases, a refund will be issued.


8. Delivery and Risk

Delivery is governed by our Shipping & Delivery Policy.

In accordance with the Consumer Protection Act, risk of loss or damage remains with us until delivery has been completed as defined in that Policy.


9. Returns, Defects, and CPA Rights

Nothing in these Terms limits your rights under the Consumer Protection Act.

If goods are defective, you are entitled within six (6) months of delivery to a repair, replacement, or refund as provided under Section 56 of the Consumer Protection Act.

This does not apply to:

• Change-of-mind purchases;
• Dissatisfaction with pull rates or card contents;
• Market value fluctuations;
• Grading dissatisfaction;
• Normal retail packaging wear as described in Section 5.

Where goods are returned due to customer error (for example, incorrect delivery information), refunds may be reduced by direct costs incurred, as permitted by applicable law.


10. Chargebacks and Payment Disputes

You agree to contact us to resolve any order issues before initiating a chargeback.

Where a chargeback is initiated, we reserve the right to provide transaction records, delivery confirmation (including PIN verification where applicable), and product authenticity evidence to the relevant payment provider.

Initiating a fraudulent or unjustified chargeback may result in:

• Recovery action through lawful means;
• Refusal of future purchases.

Nothing in this clause limits your lawful rights to dispute genuinely unauthorised transactions.


11. Limitation of Liability

To the maximum extent permitted by law:

Our total liability arising from any claim relating to a specific product shall not exceed the purchase price paid for that product.

We are not liable for indirect, incidental, or consequential losses, including loss arising from market volatility or grading outcomes.

Nothing in this clause excludes liability where such exclusion is prohibited by law.


12. Privacy

Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).


13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
